Please read these Terms & Conditions before placing any orders through this website. By accessing this website or placing any order you are taken to have agreed to, and accepted, these Terms & Conditions.

These Terms & Conditions may be updated by us from time to time. Please check these Terms & Conditions for any updates before placing any order. If you do not agree to any change to the Terms & Conditions you must stop using this website immediately.

The Colour Closet Limited (“we”, “us” or “our”) is a New Zealand registered company. If you have any queries, issues or complaints please contact us on as soon as possible at info@thecolourcloset.com during our normal working hours (10am to 4pm (NZST), Monday to Friday).

This website may contain links to other websites, which are not operated by us. We have no control over such external websites and accept no responsibility for them or for any loss or damage that may arise from your use of them.
Any goods supplied by us are solely intended for domestic and private use. You agree not to use the goods for any commercial, business or resale purposes.

 

 

PRIVACY POLICY

If you wish to use any of the services offered by us or place any order, you will need to complete the online registration process and provide personal information. All personal information provided by you must be accurate in all aspects.

Your privacy is important to us. We will comply with our obligations under the Privacy Act 1993 in respect of any personal information you provide to us.

By registering with us or placing any order you consent to us collecting, using, storing and disclosing your personal information for the purposes of processing, completing and delivering your order. Any personal information you provide will not be sold or rented to any third party.

However, in order for us to contact you, process payments and deliver our products we may use other companies and individuals to perform these services on our behalf. You consent to us disclosing your personal information to third parties as necessary to process, complete and deliver your order.

You also consent to us using your personal information to process your payments, administer your account, conduct credit and other checks and to comply with any applicable laws.

Please note that you have the right to request access to, and correction of, any personal information we hold about you.

You are solely responsible for the activity that occurs on your account and you must keep your password secure. You must not use another person’s account without the other person’s express permission.

Please ensure you update your registration details where necessary and notify us immediately if there have been any breaches of security (for example, unauthorised use of your account).

The intellectual property rights in all content provided on this website remain our property or the property of our licensors. You may access the content supplied solely for your own personal use. You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content provided on this website.

 

 

TERMS OF TRADE

All orders placed through this website are subject to availability and confirmation of the order price. We reserve the right to refuse any order made by you for any reason.

Whilst we try to ensure that all details, descriptions and prices which appear on this website are accurate, errors may occur. We may change the online prices at any time. In the unlikely event that a product is listed at an incorrect price or is out of stock, we may cancel any order placed and refund the full amount of the price paid (if any).

Due to exchange rate fluctuations, the cost of goods displayed on this website may fluctuate. All prices advertised are subject to such changes.

The price of goods displayed on this website does not include delivery charges. The delivery charges will be displayed on check out and prior to confirmation of payment process.

The images of products displayed on our website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that your computer’s display of the colours accurately reflect the colour of the products. Your products may vary slightly from those images.  The packaging of the products may also vary from that shown on images on our website.

In order to contract with us you must be over 18 years of age and possess a valid credit or debit card. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods.

The issuer of your credit or debit card may charge currency conversion or other fees in relation to your order. You should check with the issuer of your credit or debit card for details of any such fees.

When you place an order, you will receive an acknowledgement email confirming receipt of your order. This email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us for the purchase of the goods will not be formed until your payment has been approved, our billing agent has debited your credit or debit card and an email confirming the dispatch of your goods has been sent.

When ordering from us please supply a physical address, such as a workplace, where there will be someone present to sign for your item between the delivery hours of 9am – 5pm weekdays. Please also add a phone number, as couriers will use this to contact you if they are having difficulty delivering your parcel.

We will process your order as soon as possible, but please note that any stated delivery time is estimated and does not include any time for processing your order. Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays or events beyond our control, for which we will not be responsible. We will email you a confirmation once your order has been shipped, which will include a link to enable you to track progress of your parcel.

Upon delivery to the carrier, responsibility for the goods contained in your order passes to you.  A signature for any goods delivered is required.  The evidence of a signature received at the delivery address provided by you is evidence of delivery and completion of your order.

Items in your order may be subject to taxes, customs duties and fees levied by the country destination. The recipient of the shipment is the importer of record in the country of destination and is responsible for all taxes, customs duties and any fees payable. We take no responsibility for charges or delays incurred. Customs policies vary widely from country to country and you should contact your local customs office for more information.  You must comply with all applicable laws and regulations of the country for which the goods are destined. We will not be liable or responsible if you breach any such law.

No delay in any enforcement of these Terms & Conditions shall be taken to be a waiver of any right or remedy available to us.

These Terms & Conditions constitute the entire agreement between you and us and are to be construed in accordance with the laws of New Zealand.  You agree to the exclusive jurisdiction of the New Zealand courts.

 

 

LIMITATION OF LIABILITY AND INDEMNITY

All express or implied guarantees, warranties and representations are excluded from these Terms & Conditions to the maximum extent permitted by law, including but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. Where not otherwise excluded, our liability is limited to the total amount of the purchase price paid for the relevant order of goods.

In addition, to the extent permitted by law, we will not be liable to you or any third party under any circumstances for, and no measure of damages will include, special, indirect, consequential, incidental or punitive damages or damages for loss of profits, revenue, goodwill, anticipated savings or loss or corruption of data, whether in contract, tort (including negligence), in equity, under statute, under an indemnity, based on fundamental breach or breach of a fundamental term or on any other basis, whether or not such loss or damage was foreseeable and even if advised of the possibility of the loss or damage.

Except as otherwise provided in the Consumer Guarantees Act 1993 and the Fair Trading Act 1989, your sole remedy in relation to the breach of any warranty not excludable at law under these Terms & Conditions will be for us to repair or replace any faulty goods, at our option, provided that if neither option is available to us (as determined solely by us) we may refund the price paid for the relevant goods.

You agree to indemnify, defend and hold harmless, us, our directors, officers, employees, consultants, agents, and affiliates, from any and all third party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising directly or indirectly from your use of this website or your breach of these Terms & Conditions.

If any part of these Terms & Conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of the Terms & Conditions will not be affected and all other clauses will remain in full force and effect. So far as possible, where any part of these Terms & Conditions can be severed to render the remaining part valid, that part shall be interpreted accordingly.

 

 

RETURNS POLICY – GENERAL TERMS

All returned items must be in its original condition, with all labels and swing tags still attached, has not been altered or worn, washed or damaged, and with proof of purchase such as a receipt/invoice. When trying on your garment please take extra care and be mindful of potential stains from makeup, deodrant etc.

We do not accept responsibility for returned items. You are responsible for the product until it reaches us. Please use an appropriate tracked postage option for your peace of mind.

Returns are typically processed within one week of receipt. Please allow additional processing time during holidays and peak periods. We will email you once we have processed your return and will keep you up to date as to progress.

We do not accept returns for those items that were on ‘Sale’ unless there is a fault with the item.

Shipping and handling charges for returns are not refundable unless the original item was incorrectly sent or faulty.

We understand that sizing can be a little confusing, so we have created a comprehensive size guide to help you find your correct size. Please check carefully and compare The Colour Closet measurements below with your own body measurements prior to placing any order.

Please do not use any sharp utensils e.g. scissors to open your packages as this may cause damage to the item.

 

 

RETURNS POLICY – FAULTY GOODS

Where goods are faulty, we will accept returns within 20 calendar days from the date we dispatch your purchase, provided the item is in original condition, with all labels and swing tags still attached, has not been worn, washed or damaged, and with proof of purchase such as a receipt/invoice.

We will either repair or replace any faulty goods, at our option, provided that if neither option is available to us (as determined solely by us) we may refund the price paid for the relevant goods.

We will refund to you the costs of returning the faulty item and cover all shipping costs for any replacement or repaired item.

Please contact us as soon as you discover the fault by sending an email to returns@thecolourcloset.com advising us of your purchase order number and a brief description of the fault. This will enable us to be aware of your impending return. Also complete the Returns Form and enclose it with the item.

As we inspect each item before we package the item and send it out to you, unacceptable returns or goods found not to be faulty will only be returned to you at your own expense.

 

 

RETURNS POLICY – CHANGE OF MIND OR INCORRECT SIZE

Where goods are not faulty, we will accept returns within 20 calendar days from the date we dispatch your purchase, provided the item is in original condition, with all labels and swing tags still attached, has not been worn, washed or damaged, and with proof of purchase such as a receipt/invoice.

Once returned goods are received, we will advise you whether your returned items have been accepted and, if so, the amount of any credit made to your account with us. Please note we will not refund the purchase price.

Unacceptable returns or goods will only be returned to you at your own expense.

Please contact us as soon as you decide to return an item by sending an email to returns@thecolourcloset.com advising us of your purchase order number and a brief description of the reason for your return

 

 

RETURNS POLICY – SIMPLE STEPS TO RETURN

  1. Print and fill in the Returns Form (download here) so we know exactly what we can help with. The completed form is to be included in your return package.
  2. Ensure that the returned item is in its original condition, with all labels and swing tags still attached, has not been altered or worn, washed or damaged, and with proof of purchase such as a receipt/invoice.
  3. As you are responsible for the item until it reaches us, please use an appropriate tracked postage option for your peace of mind.
  4. Once returned goods are received, we will advise you whether your returned items have been accepted and, if so, the amount of any credit made to your account with us.
  5. Write your name and postal address on the back of the package and please send your return to:

HOW TO SHOP

  • Select the Gallery tab or from the side bar
  • Use menu tabs to help you find what you are looking for – eg Mauri line
  • Once you have found an item you wish to purchase, select your size and colour (if applicable) and click on the ADD TO CART button near each item.
  • Review the items in your shopping cart by clicking the link in the top right corner of the page. You can remove items from your shopping cart by using the “REMOVE FROM CART” link. You can return to the Gallery to continue shopping.
  • Once you have finished with your shopping, click on the “PROCEED TO PURCHASE” link to complete your transaction.

 

 

SECURE ONLINE PAYMENTS

We provide safe and secure credit card processing utilising Pay NZ secure payment facilities. The website does not collect or retain your credit card details.

All prices are in NZ dollars and are inclusive of Goods and Service Tax (GST) where applicable.

We accept Visa or Master Card but do not accept American Express or any other credit or debit card. If your credit/debit card payment is not approved by your financial institution then we will not be able to complete the transaction and may contact you to make alternative payment arrangements.

For New Zealand clients you may make a direct payment via internet banking. When making payment via this method please deposit the total amount of the transaction into “The Colour Closet” bank account (03-0547-0006799-002) for the items ordered and we will ship them when the deposit is confirmed.

We encourage you to register/create account saving time on your next visit and be kept up to date if you wish.

SHIPPING and PACKAGING (includes Tracking)

The time it takes for your parcel to reach its destination will vary and for rural and remote areas may take longer. NZ CourierPost is used for all of our deliveries and we use their signature required service to ensure the parcel is safely delivered. We will send out with the order confirmation email; the tracking number for you to use any time to see your parcel’s progress.
